Terms of Service

1. Acceptance of Terms

By accessing or using Mimiq ("Service"), operated by Appligon ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Mimiq is an AI-powered SaaS platform that helps content creators manage direct messages, automate responses, and optimize revenue on supported platforms. The Service includes a web dashboard, API, and Chrome browser extension.

3. Eligibility

You must be at least 18 years old to use Mimiq. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

4. Account Registration

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss arising from unauthorized use of your account.

5. Subscription and Billing

Paid plans are billed on a monthly basis. You authorize us to charge your payment method on file for the applicable subscription fee. Subscriptions auto-renew unless cancelled before the renewal date. Refunds are provided at our sole discretion.

Performance-based commission fees (where applicable) are calculated based on AI-attributed revenue and billed monthly in arrears. Attribution methodology is described in our documentation.

6. AI-Generated Content

Mimiq uses artificial intelligence to generate message drafts. You acknowledge that:

  • AI-generated content is provided as suggestions and may require review before sending.
  • You are solely responsible for all messages sent from your connected platform accounts, whether manually composed or AI-assisted.
  • AI-generated content may not always be accurate, appropriate, or aligned with your intent.
  • We implement safety filters but cannot guarantee complete content moderation.

7. Platform Compliance

You are responsible for complying with the terms of service of any third-party platform you connect to Mimiq (e.g., OnlyFans, Fansly, Fanvue). We do not guarantee that use of Mimiq complies with any third-party platform's terms. Use of automation tools may carry risks including account suspension on third-party platforms.

8. Prohibited Uses

You agree not to:

  • Use the Service for any illegal purpose or in violation of applicable laws.
  • Generate, distribute, or facilitate content involving minors.
  • Attempt to reverse engineer, decompile, or extract the source code of the Service.
  • Use the Service to harass, threaten, or send unsolicited messages.
  • Share your account credentials with third parties.
  • Circumvent safety filters or content moderation systems.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described therein.

10. Intellectual Property

The Service, including its design, code, and AI models, is owned by Appligon and protected by intellectual property laws. You retain ownership of your content. By using the Service, you grant us a limited license to process your data as necessary to provide the Service.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MIMIQ AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

13. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately. You may request deletion of your data pursuant to our Privacy Policy.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the updated Terms.
